1. Who we are
FairLoop is a digital marketplace platform, operated by MB Kermis in Oss, the Netherlands, Chamber of Commerce no. 74547089. The platform is available at fairloop.nl in Dutch, English, German, French and Spanish.
2. Applicability
These terms apply to everyone who creates an account or uses the platform. By registering or using the platform, you agree to these terms.
3. What FairLoop does
FairLoop is the online marketplace for the fairground industry and everyone connected to it. Operators, suppliers, service providers, municipalities and other parties can post listings and do business. The platform is open to both businesses and consumers. MB Kermis is not a party to any transaction made via the platform.
There are four listing types:
- Sale by negotiation — price and terms are arranged outside the platform
- Direct sale via Stripe — buyer pays via the platform, seller pays 5% commission
- Job listings — posted by employers
- Available dates — free dates for fairground operators
Listings are automatically translated. The seller remains responsible for the accuracy of the content in all languages.
4. Your account
You must be at least 18 years old and provide accurate information. Your account is personal and may not be shared. Report suspected misuse immediately via info@fairloop.nl.
MB Kermis may restrict or terminate your account if you violate these terms. Business users will receive written notice at least 30 days in advance, unless fraud or serious misuse is involved. You can cancel your account at any time via info@fairloop.nl.
5. What we expect from each other
As a seller you are responsible for your listing. Provide an honest description, correct price, clear photos, disclosure of defects and relevant inspection documents. Only list what you are legally entitled to sell.
As a buyer you are responsible for your own due diligence. FairLoop cannot verify the condition or legal status of listed items. Inspect goods before closing a deal.
6. Payments and commission
With direct sales, the buyer pays via Stripe. FairLoop deducts 5% commission from the payout to the seller. With sales by negotiation, everything is handled outside the platform and no commission applies.
In the event of a payment dispute, you can use Stripe's dispute process. MB Kermis will provide available platform information upon request.
7. Featured listings and promotion
Listings can be featured in prominent positions on the platform, such as the homepage, for a separately agreed fee. Featured placements are invoiced outside Stripe and do not guarantee responses or results.
MB Kermis may also distribute listings via social media, organically or through paid promotion. By posting a listing, you consent to this. You can object via info@fairloop.nl.
8. Right of withdrawal
If a consumer purchases via Stripe from a professional seller, the consumer has the legal right to withdraw from the purchase within 14 days without giving a reason. The consumer exercises this right by notifying the seller in writing. The seller is responsible for handling the withdrawal correctly. No right of withdrawal applies to transactions between private individuals.
9. Prohibited conduct
Prohibited on FairLoop: misleading information, illegal or stolen goods, counterfeits, infringement of intellectual property rights, spam and discriminatory content. Intimidation or threatening behaviour results in immediate suspension. Automated systems and scrapers are not permitted without the prior written consent of MB Kermis.
10. Moderation and complaints
MB Kermis may refuse or remove content that conflicts with these terms, the law or public decency. Report inappropriate content via info@fairloop.nl; we aim to respond within five working days.
Business users can submit complaints about decisions made by MB Kermis via info@fairloop.nl (P2B Regulation EU 2019/1150). MB Kermis will respond in writing within fourteen days. Listings are ranked by relevance, completeness and recency. Featured listings are the only paid exception to this ranking and are labelled as such.
11. Liability
MB Kermis, as a platform operator, is not liable for the content of listings, the condition of listed items, failed transactions, platform downtime or the actions of third parties such as Stripe. To the extent that liability is established, it is limited to the commission received in the relevant case, with a maximum of €500. Liability for consequential damages or loss of profit is excluded.
12. Intellectual property
All rights to the platform, including name, logo, design and software, are held by MB Kermis. You retain rights to your own listing content, but grant MB Kermis a non-exclusive licence to use that content for the operation of the platform, automatic translation and external promotion. Copying or distributing platform elements without prior written permission is not permitted.
13. Governing law and disputes
These terms are governed by Dutch law. The Dutch version of these terms always takes precedence over other language versions. In the event of a dispute, please contact us first via info@fairloop.nl. For disputes between consumers and professional sellers, the European ODR platform is also available at ec.europa.eu/odr. If we cannot resolve the dispute, the competent court in the district of Oost-Brabant has jurisdiction.
14. Amendments
You will be notified by email at least 30 days before any material changes take effect. Continued use of the platform after that date constitutes acceptance of the updated terms. If you do not agree, you can cancel your account via info@fairloop.nl.
